Teenager battles to keep 9mm bullet lodged in his forehead
REPORTED :-December 24, 2006
A TEENAGER accused of attempted murder is opposing the removal of a 9mm bullet embedded in his forehead after prosecutors issued a search warrant for it.
Joshua Bush, 17, from Port Arthur, Texas, whom police say has admitted to being the leader of the Young Blood Gorillas street gang, wants the round to stay where it is. BUT prosecutors say it could prove Bush's guilt.
How it got there is disputed. Police allege it was fired by Alan Olive, a used car salesman, when Bush confronted him after three fellow gang members were arrested for stealing cars.
Mr Olive, a competition pistol shooter, said that a man shot at him and he returned fire, hitting him in the head.
Bush first claimed the large lump above his eye was a basketball injury. But he later told doctors he had been hit by a stray 9mm bullet while lying in his flat.
Ballistic analysis of the bullet would establish whether it was fired by Mr Olive.
Rife Kimler, the teenager's lawyer, said an operation to remove the round would not be life-threatening, but would be a violation of her client's rights. "When the medical profession divorces itself from its own responsibility and makes itself an arm of the state, it's a dangerous path," she said.
Prosecutor Ramon Rodriguez said gang members who took part in the robbery identified Bush as having been involved. Bush admitted this, but denied any part in the shooting.
"The officers noticed the guy looks like hell," said Mr Rodriguez. "One of his eyes is black and he has a big knot on his forehead. He tells police he got hurt playing basketball."
But after Bush turned up at a hospital to have the injury treated "officers started putting events together".
Mr Olive said he had been cleaning up at his car yard after the arrests when a man (Bush) appeared and threatened to kill him if he helped police investigating the robbery. The man then fired at Olive and the pair exchanged shots.
